Informal Negotiations

Before initiating arbitration, both parties agree to attempt to resolve any dispute (“Dispute”) informally for at least 60 days following written notice.

Binding Arbitration

Any Dispute arising from this agreement shall be resolved by a single arbitrator appointed in accordance with the rules of the European Court of Arbitration.

  • Applicable law: Laws of the United Kingdom

Restrictions

To the extent permitted by law:

  • Arbitration will address only the individual Dispute between the Parties.

  • No class actions or representative actions are permitted.

  • Proceedings may not be joined with those of other individuals.

Exceptions

The following matters are exempt from informal negotiation and arbitration:

  1. Disputes regarding intellectual property rights

  2. Claims involving theft, piracy, privacy violations, or unauthorized use

  3. Requests for injunctive relief

If any part of this arbitration clause is deemed unlawful, those specific disputes shall be resolved in a court of competent jurisdiction, as identified above.


Corrections
